Intrastate drivers in Florida now have until Jan. 1, 2020 to adopt the use of ELDs, according to Derek Barrs, chief of commercial vehicle enforcement for the Florida Highway Safety Department. The move follows the Texas mandate, which requires intrastate drivers to use ELDs by Dec. 19, 2019.
In June 2019, the Florida legislature adopted the Federal Motor Carrier Safety Administration (FMCSA) regulations into state law and applied it to intrastate carriers. The effective date for intrastate drivers to comply is “after Dec. 31, 2019.”
“So, if you’re driving timber from upstate Central Florida, say north of Orlando, south to Miami for final sale, that would be intrastate commerce within the state of Florida, and this will be applicable to your operation,” explains Travis Baskin, head of regulatory affairs at KeepTruckin.
Florida and Texas drivers need to follow in-state hours rules that include bigger limits than the interstate rule, including:
- 12 hours of total daily drive time
- Lengthier time for on-duty status
- Longer weekly cumulative limits
Drivers who are exempt from the ELD mandate under FMCSA’s regulations will be required to use ELDs in Texas and Florida.
The difference between interstate and intrastate
According to the FMCSA, interstate is driving from one state to another while intrastate refers to driving within a single state. Here are more details from the FMCSA’s website to help you determine whether you are an intrastate or an interstate driver:
Interstate commerce is when you drive a commercial motor vehicle:
- from one State to another State or a foreign country
- between two places within a State, but during part of the trip, the CMV crosses into another State or foreign country
- between two places within a State, but the cargo or passengers are part of a trip that began or will end in another State or foreign country
Intrastate commerce is when you drive a CMV within a State and you do not meet any of the descriptions above for interstate commerce.
If you operate in both intrastate commerce and interstate commerce, you must choose interstate commerce.
Exemptions from the ELD mandate
There is an exemption in Florida for truckers hauling agricultural products within a 150 air-mile radius.
